Car Insurance Assumptions

Unless otherwise declared by you and accepted in writing by Zurich, you agree that the following Assumptions are accurate. If you cannot agree to these Assumptions we will be unable to provide you with a quote.

 

When deciding what Private Car insurance we can offer to you and the premium required for same, we make a number of assumptions about you, your car, the previous driving & claims history of you and anyone else who will be insured under your policy and the accuracy of the information that you have provided to us.

It is important that you fully read, understand and acknowledge these assumptions. If we become aware that you have failed to satisfy these assumptions, we may withdraw our offer and/or change the premium or level of cover which we have previously offered to you. If the policy has already incepted, we may void the contract of insurance and, in the event of an accident occurring, you may not have cover in place.

In offering you a Private Car insurance quote via our www.zurich.ie website, we assume the following:

 

1. Assumptions about your car

The Vehicle for which insurance cover is sought:

(a) is owned by and registered to you and/or your spouse (where 'spouse' is taken to mean that person legally recognised in the Republic of Ireland as your husband, wife or civil partner)

(b) is registered in the Republic of Ireland

(c) has not been imported, except where the Vehicle was originally registered in the United Kingdom

(d)has not been modified in any way from the manufacturer's specification including, but not limited to, any modification(s) which affected the performance, cosmetic appearance or safety features of the Vehicle

(e) is registered with the Revenue Commissioners as a Private Car unless otherwise declared by you and accepted by us

(f) will not be used for commercial travelling or airside at airports

(g) will not have annual mileage in excess of 50,000km

(h) is a Right Hand Drive Vehicle

 

2. Assumptions about you and anyone else who you are requesting to be insured under your policy

You and any other person(s) driving the car:      

(a) are permanently resident in the Republic of Ireland

(b) have never been refused motor insurance or been refused renewal of an existing motor insurance policy by an insurer

(c) have never had special or unusual terms or restrictions applied to a motor insurance policy or had a motor insurance policy cancelled or declared void by an insurer

(d) have never been convicted of any motoring or non-motoring offence, other than convictons which are deemed spent under the Criminal Justice (Spent Convictions and Certain Disclosures) Act 2016*

(e) are not currently disqualified from driving or have not previously been disqualified from driving in Ireland or any other jurisdiction

(f)  are not the subject of any Garda enquiries nor have any motoring or non-motoring prosecutions pending

(g) do not currently have more than 5 (five) penalty points recorded on their Driving Licence and none of these were awarded in a Court of Law nor subject to a Court Fine

(h) where applicable, have disclosed any mental or physical condition(s) that may affect their safe driving ability to the National Driver Licence Service and have subsequently been issued with a valid Driving Licence

* If you are in doubt as to whether a conviction is deemed spent under this Act, we strongly recommend that you seek guidance from a qualified legal professional, as failure to answer this question correctly could result in your insurance contract being invalidated or cancelled.

 

3. Assumptions about your driving experience (including your NCD)

The No Claims Discount (NCD) disclosed by you in the course of obtaining the quotation:

(a) has been earned on a Private Car insurance policy issued in your name

(b) has been issued by an insurer in the Republic of Ireland or the United Kingdom unless otherwise declared by you and accepted by us

(c) relates to a policy which has expired within the last 2 (two) years

(d) is not being used on any other motor insurance policy

(e) where applicable, the Named Driving Experience disclosed by you in the course of obtaining the quotation relates to your Claims Free Driving Experience gained on another Private Car insurance policy issued in the Republic of Ireland or the United Kingdom and which is currently active or has expired within the last 12 (twelve) months.

Please note that you will be required to provide us with proof of your No Claims Discount and/or Named Driving Experience from the relevant insurer of that insurance policy.

 

4. Assumptions about your quote

The premium quotation provided by us:

(a) is valid for a period of 7 days, effective from the time that the quote is issued by us to you

(b) is based on the Cover Start Date declared by you

(c) assumes that the Main Driver of the insured vehicle declared to us is correctly stated and is an accurate reflection of the risk. Please be advised that any misrepresentation made by you in order to obtain a lower premium quotation could result in cancellation of your policy and the rejection of any claims made by you.

(d) assumes that all of the information provided by You in the course of completing this application for Private Car insurance is accurate and true in every respect.

(e) may include discounts which are exclusive to online customers. Please note that these discounts may vary from time to time at our discretion.

(f) You agree that the information provided by you in the course of completing this application for Private Car insurance shall form the basis of the contract between you and Zurich.     

 

Important notice: Material facts and non-disclosure

You have a continuous duty to disclose all Material Facts to us. Your failure to disclose a Material Fact(s) could result in your contract being invalidated or cancelled, a claim not being paid or difficulty in obtaining insurance in the future. Material Facts are those facts which might influence our acceptance or assessment of your application for motor insurance. If you are in doubt as to whether a fact is material you should disclose it to us.
